Privacy Policy — The Daily Art Cult

The Daily Art Cult is a slow-luxury philosophical audio platform working to create bespoke, interpretable, and deeply personal experiences at the intersection of philosophy, voice, and memory.

This Privacy Policy explains how we collect, use, disclose, and process your personal data when you use our website, the Listening Booth, Immortality Projects, bespoke audiobook subscriptions, or other The Daily Art Cult products and services (the "Services"). This Privacy Policy does not apply to content that we process on behalf of enterprise or institutional customers of our business offerings. Our use of that data is governed by our customer agreements.

Please see our Non-User Privacy Policy for information on how our AI-assisted audio generation systems are trained, and how personal data obtained from third party sources may be used when developing or delivering our Services.

This Privacy Policy also describes your privacy rights. More information about your rights, and how to exercise them, is set out in Section 4 ("Rights and Choices").

If you are located in Canada, Brazil, or the Republic of Korea, please read the relevant Regional Supplemental Disclosure which applies to you. If you are located in Washington or a state with similar consumer health data laws, please read our Consumer Health Data Privacy Policy if you integrate third party applications with our Services.

Section 01

Collection of Personal Data

We collect the following categories of personal data:

Personal data you provide to us directly

Identity and Contact Data: The Daily Art Cult collects identifiers, including your name, honorific, email address, and phone number when you sign up for a Daily Art Cult account, subscribe to our Services, or request information. We may also generate indirect identifiers (e.g., "PATRON_00127").
Payment Information: We collect your payment information if you choose to purchase access to The Daily Art Cult's Services. Payment processing is handled by Paddle as our Merchant of Record; The Daily Art Cult does not store raw card data.
Inputs and Outputs: You are able to interact with our Services in a variety of formats, including but not limited to: the Listening Booth (three-question emotional intake flow), profile generation via uploaded .md files, the Immortality Projects voice recording sessions, bespoke audiobook generation sessions, and connected third-party services. The content you submit through these interactions — including files you upload, integrations you enable, and voice recordings you provide — are your "Inputs." Inputs generate responses, audio reflections, and narrations ("Outputs"). If you include personal data or reference external content in your Inputs, we will collect that information and it may be reproduced in your Outputs. Depending on the features you activate, some Outputs may result in actions with effects beyond the Services themselves.
Voice and Biometric Data (Immortality Projects): If you participate in the Immortality Projects feature, you may submit voice recordings, vocal samples, or transcriptions of deceased or living persons on whose behalf you act. This data is treated as highly sensitive. It is processed solely to generate the experience you have authorized and is never used for general model training without explicit written consent. You are responsible for ensuring you hold the legal right to submit such recordings.
Profile Context Files: If you submit a personal context .md file for bespoke audio personalization, we store and process that file to generate your Daily Triptych and Sunday Synthesis audiobooks. This file may contain sensitive personal information which you choose to provide voluntarily.
Feedback on your use of our Services: We appreciate feedback, including ideas, ratings, and suggestions for improvement ("Feedback"). If you rate an audio reflection or Output, we may store the entire related session as part of your Feedback.
Study Participation Data: If you participate in The Daily Art Cult research studies, listening surveys, or interviews, we collect the responses you provide, associated account data, and related Technical Information.
Communication Information: If you communicate with us, including via our Crisp support interface or email, we collect your name, contact information, and the contents of any messages you send.
Gift Card and Physical Product Data: If you purchase a physical gift card or physical product, we collect your shipping address, recipient information, and delivery confirmation data, processed through our Supabase-backed fulfilment system.
Verification Data: In certain circumstances — particularly for Immortality Projects consent verification — we may ask you to verify your age or identity. Data collected may include a government-issued identity document, your image in photo or video form, facial geometry templates (which may be considered biometric data in some jurisdictions), and the result of the verification check.

Your responsibility. When you provide Inputs — including by uploading files, granting access to third-party services, or submitting voice recordings — you are responsible for ensuring you have the necessary rights, permissions, or authority to do so. This applies with particular force to voice recordings submitted through the Immortality Projects feature.

Personal data we receive automatically from your use of the Services

When you use the Services, we also receive certain technical data automatically (collectively, "Technical Information"):

Device and Connection Information: Consistent with your device or browser permissions, your device automatically sends us information about when and how you access our Services. This includes your device type, operating system, browser information, IP address, time zone, and related identifiers.
Usage Information: We collect information about your use of the Services, such as dates and times of access, listening history, pages viewed, worldview selections made, Listening Booth responses, and information about third-party applications or content you integrate.
Log and Troubleshooting Information: We collect information about how our Services perform when you use them, including log files and error state data.
Cookies & Similar Technologies: We and our service providers use cookies, scripts, or similar technologies to manage the Services and to collect information about you and your usage. For more details, please visit our Cookie Policy.

Personal data we collect or receive to train or improve our systems

The Daily Art Cult may obtain or generate personal data from the following sources to improve our audio generation and personalization systems:

Publicly available information via the internet
Datasets obtained through commercial agreements with third party providers
Data that subscribers or participants provide, including Inputs and Outputs from our Services (unless you opt out)
Feedback that users explicitly provide about our Services
Materials flagged for safety, security, or policy review
Data that we generate internally for system development purposes

Section 02

Uses of Personal Data Permitted Under Applicable Data Protection Laws

We use your personal data for the following purposes:

To provide, maintain and facilitate any products and services offered to you with respect to your Daily Art Cult account, governed by our Terms of Service;
To provide, maintain and facilitate optional services and features that enhance platform functionality and user experience — including the Listening Booth, bespoke audiobook generation, Immortality Projects, and physical gift card fulfilment;
To provide you with service updates, communications, and tailored recommendations about our Services that may be of interest to you;
To create and administer your Daily Art Cult account;
To facilitate payments for products and services provided by The Daily Art Cult via Paddle, our Merchant of Record;
To prevent and investigate fraud, abuse, and violations of our Usage Policy, unlawful or criminal activity, unauthorized access to or use of personal data or The Daily Art Cult systems, and to protect our rights and the rights of others;
To investigate and resolve disputes;
To investigate and resolve security issues;
To debug and to identify and repair errors that impair existing functionality;
To improve the Services and conduct research, including improving our audio personalization systems and understanding listener behavior;
To enforce our Terms of Service and similar terms and agreements, including our Usage Policy.

We may use your Inputs and Outputs to improve The Daily Art Cult's systems and personalization models, unless you opt out through your account settings. Even if you opt out, we will use Inputs and Outputs for safety review and policy enforcement where your sessions have been flagged for harmful content or where you have explicitly reported materials to us.

Section 03

Recipients and Third-Party Data Sources

The Daily Art Cult will disclose personal data to, or receive personal data from, the following categories of third parties:

Affiliates & corporate partners: The Daily Art Cult discloses personal data between and among its affiliates and related entities.
Service providers & business partners: We may disclose personal data with service providers and business partners for a variety of business purposes, including: data hosting (Supabase, GitHub Pages), AI audio generation (ElevenLabs, Azure Neural TTS), AI reasoning and personalization (Google Gemini), payment processing (Paddle), customer support (Crisp), and security and compliance. A full list of our active subprocessors is available on request.
Your Organization or Administrator: If you use an email address owned by your employer or another organization, your account may be linked to the organization's enterprise account with us, as described in our Consumer Terms of Service.

The Daily Art Cult may also receive or disclose personal data in the following circumstances:

As part of a significant corporate event: If The Daily Art Cult is involved in a merger, acquisition, bankruptcy, or other situation involving the transfer of business assets, we will receive or disclose your personal data as part of those transactions.
Third-Party Websites, Integrations, and Services: Our Services allow you to connect to and interact with third-party applications, services, and content. When you enable such integrations, those third parties receive data directly and process it according to their own privacy policies. We are not responsible for the data practices of third-party services.
Pursuant to regulatory or legal requirements, safety, and rights protection: We may share personal data with government authorities, law enforcement, or other third parties where, based on information available to us, we have a good-faith belief that disclosure is reasonably necessary to (i) comply with applicable law, regulation, or legal process; (ii) prevent serious harm to any person or to property; (iii) detect, prevent, or otherwise address fraud or other illegal activity; or (iv) enforce our terms, or protect the rights, property, security, or safety of The Daily Art Cult, our subscribers, or others.
Research publications: We may publish aggregated, de-identified, or anonymized findings from our research, including research into listener behavior and audio philosophy platform design.
With an individual's consent: The Daily Art Cult will otherwise disclose personal data when an individual gives us permission or directs us to disclose this information.

We do not sell your personal data to third parties.

Section 04

Rights and Choices

Depending on where you live and the laws that apply in your country of residence, you may enjoy certain rights regarding your personal data. We strive to prioritize the protection of personal data and comply with all applicable privacy laws.

To exercise your rights, you or an authorized agent may submit a request by contacting us. After we receive your request, we may verify it by requesting information sufficient to confirm your identity. We will respond within the period required by the data protection law applicable to you.

You may also have the right to appeal requests that we deny by emailing privacy@thedailyartcult.lol. The Daily Art Cult will not discriminate against you for exercising privacy rights you may hold.

Right to know: The right to know what personal data The Daily Art Cult processes about you, including categories of data, sources, purposes, and categories of third parties to whom we disclose it.
Access & data portability: The right to request a copy of the personal data The Daily Art Cult processes about you, subject to certain exceptions and applicable law.
Deletion: The right to request that we delete personal data collected from you when you use our Services, subject to certain exceptions. You may delete individual conversations and listening sessions, which will be removed immediately from your account history and automatically deleted from our back-end within 30 days.
Correction: The right to request that we correct inaccurate personal data The Daily Art Cult retains about you, subject to certain exceptions.
Objection: The right to object to processing of your personal data, including for direct marketing purposes. You may opt out of future direct marketing messages using the unsubscribe link in such communications.
Restriction: The right to restrict our processing of your personal data in certain circumstances.
Withdrawal of consent: Where our processing of your personal data is based on consent, you have the right to withdraw your consent at any time. Withdrawal will not affect the lawfulness of processing based on consent before its withdrawal.
Automated decision-making: The Daily Art Cult does not engage in decision making based solely on automated processing or profiling that produces a legal effect or significantly affects you in a similar way.
Sale & targeted advertising: The Daily Art Cult does not "sell" your personal data as that term is defined by applicable laws. You can opt out of sharing your personal data for targeted advertising to promote our products. We honor global privacy controls.

Section 05

Data Transfers

The Daily Art Cult operates across international territories. When you access our Services from outside the Philippines, your personal data may be transferred to our servers or to servers of our service providers in other countries — including the United States, Ireland, and other locations — for the purposes outlined in Section 2 of this Privacy Policy.

Where The Daily Art Cult transfers information outside the European Economic Area (EEA) or the United Kingdom, we ensure it benefits from an adequate level of data protection by relying on:

Adequacy decisions: Decisions from the European Commission or equivalent bodies recognizing that a given country offers adequate data protection. We transfer your information to some countries with such decisions where applicable.
Standard contractual clauses: Contractual clauses approved by the European Commission under Article 46 GDPR that allow companies in the EEA to transfer data outside the EEA. We rely on these to transfer information to certain service providers in countries without an adequacy decision.

Section 06

Data Retention, Data Lifecycle, and Security Controls

The Daily Art Cult retains your personal data for as long as reasonably necessary for the purposes outlined in this Privacy Policy. When personal data collected is no longer required, we and our service providers will perform the necessary procedures for destroying, deleting, erasing, or converting it into anonymous form as permitted or required under applicable laws.

Aggregated or De-Identified Information

We apply aggregation and de-identification techniques as part of our data minimization practices. For example:

When you submit Feedback, we disassociate Inputs and Outputs from your user ID to use them for improving our systems.
If our systems flag Inputs or Outputs for harmful content or policy violations, we disassociate the content from your user ID for trust and safety review. We may re-identify the content to enforce our Terms of Service with the responsible user if necessary.
To improve user experience, we may analyze and aggregate general listener behavior and usage data in a form that does not identify individual users.

Where data is de-identified, The Daily Art Cult will maintain and use this information in its de-identified form and will not attempt to re-identify it, except as permitted by law.

Security Controls Relating to our Processing of Personal Data

We implement appropriate technical and organizational security measures designed to protect personal data from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Our platform architecture is informed by compartmentalization principles — personal context files are processed in isolated execution environments and never co-mingled with public-facing systems.

Section 07

Children

Our Services are not directed towards, and we do not knowingly collect, use, disclose, sell, or share any information from children under the age of 18. We have measures in place to detect and remove individuals under 18 from our Services.

If you become aware that a child under the age of 18 has provided any personal data to us while using our Services, please email us at privacy@thedailyartcult.lol and we will investigate the matter and, if appropriate, delete the personal data.

The Daily Art Cult is domiciled in the Philippines. The Republic Act No. 10173, or the Data Privacy Act of 2012 (DPA), governs our collection, use, and protection of personal data for Philippine-based operations.
